Thank you for reviewing Sticky, Inc.'s ("Sticky", “we,” “us” or “our”) privacy policy for our Internet web Site located at the URL www.Sticky.ai ("Site") and our marketing study platform services (“Services”). This Privacy Policy details certain policies implemented throughout Sticky governing Sticky’s collection and use of personally identifiable information about users of our Site and Services.  “Customer(s)” are business users for whom we perform our Services. “Participant(s)” are individual users that participate in studies on the Services.

 

Information Collection and Use

Personally Identifiable Information We Collect: You can generally visit our Site without having to submit any personally identifiable information about yourself to us. 

If you set up an account with us on the Site or Services as a Customer, we will collect personally identifiable information from you such as your name, username, work email address and billing information.  

If you are a Participant, we will collect your age and gender.  When you participate in a study, we will record your facial and eye movements.  We also will collect data about where Participants looked at the screen when participating in a study and we will process this data into non-personally identifiable x,y coordinates.

If you are a Participant that participates in a study either as part of a panel provided to us from a Customer or as part of a panel provided to us from a panel company, we will receive the general demographic information for the group you are in as well as a unique id number.  We will link this id number to aggregate information that we collect (as detailed below). We will also receive your username if you access our Services through a panel company or other service.  

If you are a Participant that participates in a study either as part of a panel provided to us from a Customer or as part of a panel provided to us from a panel company, the Customer’s and panel company’s use of your personally identifiable information will be governed by the Customer’s own and the panel company’s own (as applicable) privacy policy.

If you are a Participant and answer a survey question, we will collect any personally identifiable information that you include in your answer.  

If you contact us with questions or request information we will collect your name, email address and any other personally identifiable information that you voluntarily transmit with your communications to us. 

 

Aggregate Information We Collect

Through certain third party analytic providers, as discussed below in the Cookies and Online Tracking Section, we may track information that will be maintained, used and disclosed in aggregate form only and which will not contain your personally identifiable information.  However, we may link this aggregate information to the personally identifiable information that we have received or collected from you.  For example, without limitation, we may track your browser type, operating system type, screen resolution and other non-personally identifiable information regarding your system.  

How we Use Information:

If you are a Customer, we will use your personally identifiable information to perform our Services for you and to provide customer support. 

If you are a Participant, we will use your personally identifiable information to conduct studies on our Services for Customers, provide support and improve our Services.  

We may also send you marketing and promotions regarding the Site and Services or other products or services we believe may be of interest to you.  If you do not wish to receive these marketing or promotions from us, you may opt-out as set forth in the message. 

We may analyze the aggregate data that we collect for trends and statistics in the aggregate, and we may use such aggregate information to administer the Site and for debugging purposes.

 

Children's Privacy

Sticky recognizes the privacy interests of children and we encourage parents and guardians to take an active role in their children's online activities and interests. The Site and the Services are not directed to children under the age of 13. Sticky does not target this Site or Services to children under 13. Sticky does not knowingly collect personally identifiable information from children under the age of 13. If you are under the age of 13, please do not participate in any study and do not provide us with any personally identifiable information.

 

Cookies and Online Tracking

We may use small text files called cookies to improve overall Site experience. A cookie is a piece of data stored on the user's hard drive containing information about the user. Cookies generally do not permit us to personally identify you.  We generally use session cookies to save your preferences and such cookies expire when you close your browser. We set a persistent cookie that we assign to you when you use our Site to keep you logged in to the Site.  You can read more about cookies at www.allaboutcookies.org.

Sticky itself does not track users over time and across the Site and the Services and therefore does not respond to Do Not Track (DNT) signals.  

However, third party providers of external services like web traffic analysis services, such as Google Analytics, Intercom or Mixpanel may track users over time and over our Site and third party websites and such third parties may also place cookies, via our Site. These cookies are likely to be analytical, performance cookies or targeting cookies.  These cookies collect information about how visitors use a website, for instance which pages visitors go to most often, and if they get error messages from web pages. Most browsers will allow you to change your settings so that third parties (particularly advertisers) know you do not want to be tracked.

 

Disclosure

We may provide your personally identifiable information and the data generated by cookies and the aggregate information to the vendors and service agencies that we may engage to assist us in providing our services to you for their use solely to provide us with such assistance. For example, we use third party hosting providers.   If you are a Participant, we also may provide your personally identifiable information to the Customer that requested the study in which you participated, for quality assurance purposes.

If an External Web Site (as defined below) directly collects personally identifiable information about you, your use of the External Web Sites is subject to the terms of use and privacy policies located on the linked to External Web Sites.  We will also disclose your personally identifiable information (a) if we are required to do so by law, regulation or other government authority or otherwise in cooperation with an ongoing investigation of a governmental authority, (b) to enforce the Sticky Terms of Use or user agreements or to protect our rights or (c) to protect the safety of users of our Site and our Services. 

We will not sell your personally identifiable information to any company or organization, but we may transfer your personally identifiable information to a successor entity upon a merger, consolidation or other corporate reorganization in which Sticky participates or to a purchaser or acquirer of all or a portion of Sticky’s assets to which this Site and our Services relates.

 

The Site and/or the Services may provide links to other Web Sites or resources over which Sticky does not have control ("External Web Sites"). Such links do not constitute an endorsement by Sticky of those External Web Sites. You acknowledge that Sticky is providing these links to you only as a convenience, and further agree that Sticky is not responsible for the content of such External Web Sites. Your use of External Web Sites is subject to the terms of use and privacy policies located on the linked to External Web Sites.

 

Security

We may employ procedural and technological measures that are generally consistent with industry practice. Such measures are reasonably designed to help protect your personally identifiable information from loss, unauthorized access, disclosure, alteration or destruction. Sticky may use measures such as password protection, secure socket layer, firewalls, encryption and other measures. 

 

Privacy Policy Updates

Sticky may need to update this Privacy Policy from time to time. If so, Sticky may send registered users an email. We will post our updated Privacy Policy on our Site located at Sticky.com and in the Services along with a notice that the Privacy Policy has been changed so you are aware of what personally identifiable information we may collect and how we may use this information. Sticky encourages you to review this Privacy Policy regularly for any changes. Your continued use of this Site, Services and/or continued provision of personally identifiable information to us will be subject to the terms of the then-current Privacy Policy.

 

Updating or Deleting Personally Identifiable Information

Sticky provides you with the ability to review, update and/or delete certain information that you provide to us by accessing your account. You also may contact us to request changes at [email protected]

 

Data Retention

We only keep your personally identifiable information for as long as we need to, to be able to use it for the reasons given in this privacy policy, and for as long as we are required to keep it by law.  You may cease providing us with personally identifiable information by terminating your participation in a study at any time.

Users Outside of the United States

Our computer systems and third party hosting provider systems are currently based in the United States, so your personal data will be processed by us in the U.S. where data protection and privacy regulations may not offer the same level of protection as in other parts of the world, such as the European Union. In particular, you are advised that the United States of America uses a sectoral model of privacy protection that relies on a mix of legislation, governmental regulation, and self-regulation. Article 26 of the European Union’s Data Protection Directive (Directive 95/46/EC, 1995 O.J. (L 281) 31) allows for transfer of personal data from the European Union to a third country if the individual has unambiguously given his or her consent to the transfer of personal information, regardless of the third country's level of protection. By using the Site and/or the Services you consent and agree to this Privacy Policy and to the processing of that information in the United States of America as described in this Privacy Policy.  In our discretion, we also may agree to enter into Model Contracts for the transfer of personal data to third countries or a data transfer agreement or we may adopt other means under applicable law for ensuring adequate safeguards.
